CAN I GET SOCIAL SECURITY DISABIITY FOR MILITARY INJURIES?

Veterans may qualify for Social Security disability benefits.  You may qualify even while you are still on active duty and still in the US armed forces -- if you are unable to perform your job based on physical and/or mental impairments.  The wounded warrior provisions of the Social Security Act provide Social Security benefits to military personnel for impairments, whether or not the impairments are related to military service.

Veterans who have been given a 100 percent permanent disability rating by the Veterans Administration can qualify for an expedited decision on their Social Security claim. You are NOT required to have a VA disability rating to apply for Social Security disability - but this rating will speed up the claim process.  Your waiting time for a Social Security decision may thus be shortened to as little as 30 days.

May you receive VA disability benefits and Social Security disability benefits at the same time?  Yes, you may.  And one benefit does not interfere with the other.  Since 1955, members of the United States armed forces have paid into the Social Security disability trust fund.  This entitles them to be covered for Social Security disability benefits in addition to any benefits they may receive from the Veterans Administration (VA).  

Social Security has its own rules--which are not identical to the VA rules for disability.  Therefore, being approved for VA benefits does not automatically give you Social Security benefits.  You must file a separate application and meet Social Security's rules for disability.

Most disability benefits today happen because the claimant convinces a judge that he or she is not able to work.  This is particularly true for claimants under the age of 50. How do you convince a judge?
